C8 Policy

We always aim to sell our PAYG SIM Card plans in a fair and straight-talking manner. But as a reseller of mobile products, Ofcom also asks that we give you a summary of a set of rules called General Condition C8, which covers sales and marketing of mobile communication services.

General Condition C8 (“C8”) is a set of rules that Ofcom wants us to follow covering how we sell mobile products and services to our customers and small businesses. The reason that Ofcom put them in place is because it receives complaints about the way certain mobile products and sales incentives, such as cashbacks, are sold to customers. As an organisation, we want to make sure that we try our best to prevent mis-selling.

These rules make sure that when we sell or market our services:

  • We give you all the information you need when you're deciding to buy a PAYG, and ask you if you would like the information provided in writing if you want some time to think about it before signing up.
  • The information that we provide is accurate and not misleading.
  • We don't contact you in an aggressive or inappropriate way.

General Condition C8 FAQ
When a customer is about to buy their new PAYG SIM Card, they should have received all the following information:

  • A description of the service and what’s included.
  • The minimum length of time that they can stay on the plan/plan validity.
  • Referral to MNO’s T&Cs including details of standard charges to other mobiles, landlines, SMS, and voicemail, payment terms and additional charges.

We need to carry out due diligence before we let an organisation (partners, sub-distributors) resell mobile services and we should keep records of the following:

  • Credit checks of all partner businesses to make sure that anyone selling the products or services doesn’t have a bad credit history of not paying its creditors.
  • That the directors of the organisation haven’t filed for bankruptcy or gone into administration in the past.
  • The above information is all up-to-date.

3.1. Where we collect information about companies we can’t pass that information on to anyone else or use it to gain unfair advantage.
3.2. We need to ask customers if they want information in a durable medium.
3.3. We need to keep all sales records for at least 6 months after the sale. The sales records must include:

  • The date of the sale.
  • Whether the sale was made face-to-face in-store, online, or over the phone.
  • The place where the sale was made (e.g., address of the retail store).
  • Copies of contracts/invoices either on paper or electronic copy.

Sales Incentive Regulation (if applicable)
Typically, UK Telecom Distribution does not offer sales incentives in relation to PAYG products. However, all staff must be aware of the regulation. A sales incentive or offer is a promise that the customer might receive a free gift when they purchase the service.

  • For these offers the customers must be told what is separate to the service that they’re buying.

All staff must ensure that customers are aware of this by:

  • Telling customers about the terms and conditions of the offer and how they can claim it.
  • Reviewing any complaints about these offers.
  • Checking advertising material that refers to these offers.
  • If a customer has redeemed the offer, the salesperson needs to keep records of the offer for at least 90 days after the redemption.
  • We need to make sure not to make it difficult for customers to claim their offer if any.
  • We should also make sure that customers received the following information in either a paper or electronic format: the full details of the company that is offering the incentive and that they will provide the deal that they are offering (including the address, telephone, e-mail contact details); a description of the offer; the terms and conditions of the offer, including how a customer can claim it.
